Pre-Loss Documentation Isn't Only an Insurance Problem
Property insurance surfaced the timestamp problem in its sharpest form. An adjuster arrives at a loss site. Photos exist. The dispute isn't about whether damage occurred but when. That distinction determines subrogation rights, fraud exposure, and liability. Courts have to answer a timing question that most documentation can't actually answer.
The same question appears in healthcare disputes, real estate closings, environmental compliance, and commercial contract litigation. The mechanism is identical. The stakes are equally real.
Healthcare: The Condition Before the Procedure
A patient undergoes a procedure. Complications arise. The dispute turns on whether the relevant condition pre-existed the treatment.
Medical records say the condition was documented before the procedure date. But an electronic health record can be amended. The amendment log may or may not exist, and in many systems it can be modified by anyone with administrative access. A timestamp in a file's metadata isn't process output. It's a field.
An independent anchor applied when the documentation is first created establishes that the record existed before the procedure date. It doesn't certify the content. It certifies the timing. Courts in federal malpractice and billing disputes apply FRE 901(b)(9) to digital records exactly as they do to insurance claim files. The question is the same: does the process that produced this record generate an accurate result?
Real Estate: The Condition Before Closing
A buyer commissions a property inspection before closing. The inspector documents the foundation, the roof, the mechanical systems. The report is a PDF with a creation date in its metadata.
Eighteen months later, there's a structural problem. The seller's position: the defect was visible in the inspection report. The buyer's position: this damage appeared after closing. Both parties have copies of the same document. Neither can independently verify when that document was created.
An anchor applied when the inspection report is finalized changes the shape of that dispute. The question shifts from "which version is authentic" to "was this document anchored before or after the closing date." That record exists on a public ledger. It's verifiable by any party to the litigation without a discovery request.
Environmental: Baseline Conditions Before Work Begins
Before industrial projects break ground, environmental consultants document site conditions. Those reports establish what was present before the work started.
Contamination discovered during or after a project triggers the same temporal question. Was it pre-existing, or did the project introduce it? The baseline report says it wasn't there before. The opposition can argue the report was produced after the fact, or modified.
Environmental litigation can run for years before adjudication. Documentation anchored to a public ledger at the time of the original site assessment provides temporal evidence that isn't controlled by any party to the dispute. Neither the consultant, the project owner, nor the regulator can alter what the anchor says.
Commercial Contracts: Version Disputes
Specification disputes often turn on which version of a document was operative at the time work was authorized. The contractor says they built to the spec in effect when the purchase order arrived. The client says the spec was revised before work began.
Both parties may have copies of documents with different dates. Without independent verification, the dispute becomes a credibility contest. A timestamped anchor on the version transmitted on a specific date gives a court a way to resolve the factual question that doesn't require choosing between competing accounts.
FRE 901(b)(9) applies to digital records in federal court regardless of the type of claim. The authentication requirement is the same: the process that produced the record must generate an accurate result. A dual-chain anchor to both Polygon and Bitcoin creates an independent verification path that opposing counsel can check through a public endpoint without making a formal records request.
FRE 902(13) goes further. It allows authentication through written certification, which eliminates the need for live expert testimony on the anchoring process itself. For litigation teams handling volume documentation across multiple matters, that reduction in authentication cost is real.
Monday Morning
If your organization creates documents that may later be cited in a dispute, pre-procedure clinical notes, property inspection reports, environmental baselines, contract specifications, the question is whether those documents are verifiably timestamped at the moment of creation.
A file's creation date in a CMS doesn't answer that question. A PDF's metadata doesn't answer it either. Both can be modified. An anchor on a public blockchain can't.
